I went to hospital last week to have my hip done. The operation went well but the ward was dirty and the bathroom a disgrace. I didn’t like the food and was glad to get home. Can I claim any compensation and if so how?
I am pleased to hear your operation was a success and hope you are now recovering well at home. It is upsetting the standard of cleanliness was not good and the food poor.
As to compensation, the law in this area is complex. I will however, try to explain it as simply as possible.
In order to claim you must show the treatment you received fell below the standard which you could expect from a competent doctor or nurse and it caused you injury. Alternatively you must show the lack of hygiene or poor food resulted in you becoming ill.
As your operation went well and you have not suffered illness from the dirty ward or poor food, then you would not be able to establish a legal claim.
However, I would strongly advise you to write a letter of complaint to the hospital detailing your experiences. Any concerns you have should be brought to the attention of the hospital authorities. If you do nothing, then nothing will change. If you tell them, they have the opportunity to address the problems. Any good organisation is pleased to receive such letters so they continue to improve their service to their patients.
