9. What happens if we do not follow these procedures?

If you fail to implement the statutory minimum requirements in a dismissal case, the dismissal will be automatically unfair, no matter how good your original case may have been. Employees with a year's service will then be able to claim unfair dismissal. Any award will be increased by between 10 and 50 per cent, unless you can prove that there were really exceptional circumstances for your failure to implement the statutory requirements.
