Professional Negligence:

  • Acting for lenders in investigations for potential mortgage fraud and related claims against solicitors, surveyors and brokers in claims for professional negligence and breach of fiduciary duty.
  • Applying successfully for an Order for Delivery Up of files of papers and other documents in the High Court in such proceedings.

Engineering and manufacturing cases: 

  • Andrew has handled a wide variety of claims for breach of contract involving allegations of satisfactory quality, fitness for purpose and failure to comply with specification of plant and machinery including boilers, foundry chimneys, power generators, conveyors, diesel trains, refuse collection vehicles and other heavy duty equipment as well as hi tech equipment and computers.

Trade Secrets:

  • Andrew recently acted for a company against a former Director and Senior employee who had taken confidential information belonging to the Company.  He successfully obtained a Search and Seize order which was executed at 2 sites in the Midlands and the North; subsequently obtained Springboard relief and Judgment in the High Court in London after a speedy trial  
  • In two other cases he acted for companies against former directors and their new employers where client lists and intellectual property belonging those companies had been taken

Disputes for Partners:

  • Acting for an individual who was expelled from a professional partnership for alleged immoral behaviour – the claim settled by mediation
  • Acting for a doctors’ practice against a disruptive partner whose behaviour was damaging the practice
  • Acting for a partner in a family farming partnership involving a dispute concerning division of property and assets

General cases:

  • Successfully acting for a partnership in recovering a trade debt of over £2 million
  • Successfully defending a six figure claim by HMRC against an individual for tax allegedly due
  • Acting for a doctor in a  pensions dispute and possible claim to the Pensions Ombudsman
  • Acting for a fruit distributor concerning the import and sale of an allegedly defective consignment of fruit from South America
  • Defending a company in a claim for defamation arising out of its disciplinary procedure

Regulatory work:

  • Acting for a company and its directors in defending a possible claim for Corporate Manslaughter and subsequent prosecution under the Health and Safety at Work Act
  • Defending a prosecution under the Health and Safety at Work Act against a Company when an employee was injured in an accident in the company’s car park
  • Defending a Director and Company in a prosecution by the Environment Agency for allegedly polluting a river with chemical waste
