Prevention of Illegal Working

New legislation was introduced on 29 February 2008 requiring all UK employers to take steps to ensure that all their employees are eligible to work in the UK before they begin their employment.

Record Keeping

Employers are required to keep copies of passports and other documents which prove the employee’s eligibility to work in the UK.

Civil Penalties

Employers found to be employing illegal workers may face a civil penalty – a fine – of up to £10,000 per illegal worker employed.  In certain circumstances an employer may be prosecuted for employing illegal workers and on conviction may face a fine or imprisonment or both.
