Partnership Disputes

Partnerships tend to be close-knit enterprises into which the individual partners have not only invested financially but also emotionally. Partnerships can dissolve for many reasons and a common scenario is when one partner's view of the future of the business has become different from those of his/her fellow partners.  Therefore, when partnerships encounter problems, there is always more at stake than just economics.

Given the delicate nature of these types of dispute, we resolve them using the most appropriate means.  Often problems are resolved by negotiation rather than through the courts. Although these disputes can become acrimonious we have enjoyed recent successes using mediation.

We've acted for a range of partnerships including professional partnerships (including medical practices, architects and surveyors), software designers, creative partnerships, and niche manufacturing companies - to name but a few.

Recent instructions have involved disputes over the basis upon which capital, profits and losses were to be shared, whether and how the partnership should be dissolved, accounting issues and even the existence (or otherwise) of a partnership.

Funding

Fixed fee, capped fee and conditional fees are all considered. We will take a pragmatic and creative approach as our aim is to foster long-term business partnerships with our clients.


Due to our extensive experience, from an early stage we will be able to confirm whether we can act on your behalf on a conditional fee basis, more commonly known as “a no win no fee agreement”.  Such an agreement simply means that if we do not succeed with your claim you will not have to pay for our services.  However, if we are successful, you will be responsible for our legal costs in accordance with the conditional fee agreement.  However, your reasonable legal costs are often recovered from the opposing party if you are successful.
