We appreciate that the decision to dispute a Will or to question the actions of executors or trustees can be a difficult one, particularly as emotions are running high and the fact that raising issues that you are concerned about may call into question the motives or decisions of other family members or trusted advisors. The decision can also be effected by worries and concerns over the amount of the legal costs that will be incurred by you in raising any issue or dispute.
We understand your worries and concerns and we can advise you about the amount of legal costs that may be incurred in pursuing any claim and discuss with you the various funding arrangements that the firm offer.
Every client has individual needs and financial resources and therefore we offer various arrangements to suit and assist clients in managing the legal costs of pursuing a claim such as;
Agreeing to put into place a payment plan whereby a fixed monthly fee is paid throughout the progress of the claim with the remainder of the legal costs to be paid at the conclusion of the claim;
Agreeing discounted charges should the claim be unsuccessful;
Agreeing to only charge legal costs in the event that any claim is successful, more commonly known as a ‘No win, No fee’ agreement;
Deferring the payment of legal costs until the end of the claim.
The type of funding arrangement the firm may be able to offer will be subject to the merits of any claim and the needs of an individual client.
