What is the Office of the Public Guardian?

The Mental Capacity Act 2005 renamed the Public Guardianship Office as the Office of the Public Guardian (OPG).  The OPG carries out administrative and regulatory functions working alongside the Court of Protection and helps to protect people by:

  • Setting up and managing a register of lasting powers of attorney (LPAs);
  • Setting up and managing a register of enduring powers of attorney (EPAs);
  • Managing a register of court orders that appoint deputies;
  • Supervising deputies;
  • Instructing the Court of Protection to visit people who may lack mental capacity;
  • Receiving reports from attorneys acting under LPAs and from deputies;
  • Providing reports to the Court of Protection in dealing with cases where there are concerns raised about the way in which attorneys or deputies are carrying out their duties.
