Highways law

In this context, the highways referred to are those routes generally used by motorised transport as opposed to rights of way predominantly used by pedestrians, riders, cyclists etc. Highways law is notoriously technical, and involves a mixture of statutory provisions contained in the Highways Act 1980. As a matter of interest the term 'highway' is not defined within the Act. The team advises in the following areas:

  • stopping up and diversion of highways
  • definition of a highway and determination of boundaries
  • legal powers and procedures
Projects that members of the team have advised on include:
  • the Environmental Impact Assessments for the King's Cross redevelopment project
  • the judicial review of the Swiss Cottage redevelopment project
  • remodelling of the West Coast Main Line Railworks (assessing the environmental impact and assisting in the Public Enquiry)
  • advising Camden Council on the redevelopment of the Kingsway High Holborn Gyratory (Proctor Street Development)
