This environment team's expertise includes advising on environmental liability and contaminated land issues. It has recently advised private landowners on proposed sewer diversion works, in connection with flood alleviation works, and acted for a sewage authority in respect of its statutory role under land drainage legislation. The team also acted for a drainage authority on issues of drainage relating to flooding, and advised a local authority on a prosecution alleging a breach of hedgerow regulations.

Recent successes include:

  • Tripartite arrangement between three Local Authorities to deliver infrastructure benefits for the Longbridge site;
  • High Court challenge quashing part of Warrington Borough Council's local plan, resulting in a groundbreaking decision regarding the relevance of the Structure Plan when formulating Green Belt policy;
  • Quashing employment policies in Tamworth Borough Council's local plan;
  • Successful negotiation of compensation for business extinguishment pending CPO action for Drinks etc. Ltd.;

And currently:

  • We have a case pending in the High Court on what constitutes "substantial completion" of a development; clarification of the House of Lords case Sage -v- Secretary of State for DETR.
