Expert witnesses- a cautionary tale

Since 2011, expert witnesses can be sued for negligence. Although the hope was that this may help to drive up levels of care and skill among professionals when acting as experts, there are signs that further improvement is still required.

Adjudication or winding-up bankruptcy?

Adjudication and the insolvency process are not always easy companions, based as they are on very different legislation. Although tempting, using the winding-up/bankruptcy route can be high risk where there is a genuine defence, set-off or cross-claim.

Root 2 – The Latest

The following 12 months has resulted in a number of strategic steps between Root 2 and HMRC. This culminated with HMRC and Root 2 appearing before the FTT in June 2018 for a test case on the efficacy of the Scheme (the Test Case), this time with regard to the substantive use of the Scheme.
